No offense to Attorney Richard Guerriero, current president of the NH Bar, but I looked him up after he surmised that the problems in family court being because the cases are “emotional.” I see no indication he has ever been in the family division. He is first and foremost a criminal defense attorney, an occupation I admire, but have only occasionally practiced. Allow me to tell you what I have witnessed in the Family Division.
Courts following no rule of law, ignoring statutory requirements and constitutional due process, stating they are not interested in evidence, refusing to enforce child support, refusing to join the Office of Child Support Enforcement to a case with felony-level arrearages to a case, erasing chronically past due felony-level child support in violation of federal law, accepting cases in which they have no subject matter jurisdiction, removing evidence from court files, forcing children to live with parents with documented history of abusing them, and making up court appointed positions (such as Guardian ad Litem for a business) and then ordering parties to pay for them. In short, they are abusing women and children. The anger at the Family Division is justified. Pass the constitutional amendment.
